The intellectual property protection about intangible cultural heritage is a problem which has always troubled the educational circle and juridical practice. Through analysis on the case "Great Grand Madam Xian", this paper thinks that the defensive protection on trademark is necessary due to the composition features and realistic difficulties of intangible cultural heritage, and omission of positive protection measures; the current legal system, judicial judgment and legislative review make the realization of defensive protection on trademark become feasible.
